iPayed™ App & Web Privacy Policy / Terms of Service

At iPayed™, we recognize that your privacy is important.  This Policy discloses the privacy practices for the Company’s Apps and Websites (collectively, the “Sites”), as well as related products and services we may offer to you (collectively referred to as the “Services”).  This Policy also covers how personal and other information that we receive or collect about you is treated.  Please read the information below to learn the following regarding your use of the Sites.

You acknowledge that this Privacy Policy is designed to be read in connection with the Terms of Use, which is available below, and that by accessing or using our Sites, you agree to be bound by the Sites’s terms and conditions, as well as this Policy.

We reserve the right to change this Privacy Policy from time to time.  We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our Sites, and by updating any privacy information on this page.  Your continued use of the Sites and or Services available through the Sites after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) your agreement to abide and be bound by that Policy.

IMPORTANT:  BY USING THE SITES AND/OR OFFERINGS AVAILABLE ON THE SITES, YOU GIVE YOUR CONSENT THAT ALL PERSONAL DATA THAT YOU SUBMIT MAY BE PROCESSED AND STORED BY US IN THE MANNER AND FOR THE PURPOSES DESCRIBED BELOW. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, DO NOT USE THE SITES.

  1. Types of Information We Collect

In order to better provide you with the Offerings (as defined in our Terms of Use), we collect three types of information about our users:  Personally Identifiable Information (“PII”), Location Information and Aggregate Information.

Personally Identifiable Information:  This refers to information that lets us know the specifics of who you are.  When you engage in certain activities on the Sites, such as registering for an account, event, submitting content and/or posting content in the user forums, making a payment, registering for contests, sending us feedback, or attending an event, we may ask you to provide certain information about yourself which we will store.

Examples of PII may include but not limited to your first, middle and last name, email address, mailing address (including zip code), date and place of birth, social security number, nationality, gender, height, eye color, hair color, Driver License/State ID number, passport number, bank account number, mother’s maiden name, telephone number, biometrics including but not limited to facial picture, fingerprints, retinal scan, voice capture and other identifying information.

Location Information:  Because our Sites are location-centric, when they are installed and at various other times, they prompt users to select location permissions, depending on the type of device.  When you use iPayed™ services, we collect, process, and store the information about your actual location, along with a time stamp.  We use location information to tailor our Services, like helping you to check-in and find local events or offers in your area or tell your friends that you are nearby.  The location information is also used to help with AML (Anti-Money Laundering) practices on the iPayed™ eBank N.A. payment system.  We use various technologies to determine your location, such as the location services of your operating system or browser and sensor data from your device (e.g., GPS data) that may help us to understand your precise location.  Unless you choose to share it with others by adding friends, the information about your whereabouts is concealed from other app users. Our Sites tell us your device’s location even if you are not directly interacting with the application. Internet Protocol (IP) addresses are part of the fabric of the internet and are assigned to a device whenever that device connects online.  When a website needs to send something to your computer, it needs your IP address to send it to the right computer. IP addresses are roughly based on geography, and as such may be used to approximate the general location of a device. Like many other Internet services, iPayed™ can use this information about your location to provide some basic services (even if precise location is not being collected from your device).  As an example, this could help us understand the state you are using our services from and, if there’s a sign-in from an unexpected place, allow us to detect unusual account activity.

Aggregate Information:  This refers to information that does not by itself identify a specific individual.  We gather certain information about you based upon where you visit on our Sites and what other Sites may have directed you to us.  This information, which is collected in a variety of different ways, is compiled and analyzed on both a personal and an aggregated basis. This information may include the App mobile device operating system, Website’s Uniform Resource Locator (“URL”) that points to the Sites you just came from, which URL you go to after visiting our Sites, what browser you are using, what device and platform you are using and your Internet Protocol (“IP”) address.

  1. How We Collect and Use Information

We do not collect any PII about you unless you voluntarily provide it to us. However, you will be required to provide certain PII to us when you elect to register an iPayed™ social app account, iPayed™ eBank N.A. account, attend an iPayed™ event, submit content and use certain products or services available on the Sites, enter a sweepstakes or contest sponsored by us or one of our partners, sign up for special offers from selected third parties, send us an email, text, submit a form or for transmitting other information by telephone or letter including instructions to make  or receive an electronic payment.

In connection with establishing an iPayed™ eBank N.A. account, to help the government fight the funding of terrorism and money laundering activities, federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account.  The PII you are voluntarily providing us will: (a) satisfy banking Know-Your-Customer (KYC) on-boarding requirements for registering your iPayed™ eBank N.A. account on our Sites; (b) satisfy digital information submission to your employers and/or for government entitlement or tax return information, for making direct deposits into your iPayed™ eBank N.A. account or other payment information.  When processing certain information, such as payment information with affiliated banking institutions or payment processors, we encrypt the transaction in order to prevent your PII from being stolen or intercepted.  Additionally, your iPayed™ eBank N.A. account information will be encrypted and stored on a restricted-access database that is away from our main Sites and only accessible by authorized users.  All facial head shot pictures uploaded to your account, by either a selfie or from a photo gallery, will be matched through facial recognition with your government ID or selfie uploads and stored in our database.  Fingerprints, retinal scans, and recorded voice snippets may also be stored in our database.

We will primarily use your PII to provide product or service offerings to you, to secure your account and for running automated background checks to satisfy KYC/AML banking and on-boarding procedures.  We will also use certain forms of PII to enhance the operation of our Sites, improve our internal marketing and promotional efforts, statistically analyze Sites use, improve our product and service offerings, and customize our Sites’s content, layout, and services.  We may use PII to deliver information to you and to contact you regarding administrative notices.  We may use your PII, only with your authorization, with affiliated third-parties of your choosing, for digital identification services. Finally, we may use your PII to resolve disputes, troubleshoot problems and enforce our agreements with you, including our Sites Terms of Use, and this Privacy Policy.

We may also collect certain Aggregate Information.  For example, we may use your location information or IP address to diagnose problems with our servers, software, to administer our Sites and to gather demographic information.  Our third-party partners may also provide us with aggregate and individual reports that will tell us statistics about our Users.

Other than as set forth herein, iPayed™ eBank N.A. will not provide any PII to any unaffiliated third-party unless required by law.
